By accessing or using AbaPeak ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. AbaPeak is operated by IT Integrated Solutions LLC.
AbaPeak is a web-based clinical documentation tool that helps Board Certified Behavior Analysts (BCBAs) and Board Certified Assistant Behavior Analysts (BCaBAs) generate structured ABA session notes in DAP format for CPT codes 97155-HN (Protocol Modification) and 97156-HN (Caregiver Training).
AbaPeak is a documentation drafting tool. Notes generated by the Service are first drafts intended for clinician review, editing, and finalization before clinical use. AbaPeak does not provide clinical advice, diagnoses, or treatment recommendations. You are solely responsible for the accuracy, completeness, and clinical appropriateness of any note you finalize and submit.
The Service is intended for licensed or credentialed ABA practitioners (BCBAs and BCaBAs) in the United States. By using AbaPeak, you represent that you hold the applicable credential required to author the note types you generate, and that you are at least 18 years of age.
AbaPeak is not a HIPAA-covered entity and does not function as a Business Associate. The Service is designed so that client identifiers are replaced with placeholders on your device before any request is transmitted. However:
Access to paid features requires a valid license key issued through Lemon Squeezy. You may not share your license key with others. You are responsible for all activity under your license key. If you believe your license key has been compromised, contact us at hello@abapeak.com immediately.
AbaPeak offers a 10-day free trial with no credit card required, subject to daily generation limits. At the end of the trial period, the Service will prompt you to subscribe to continue generating notes. Trial use is subject to all other terms in this agreement.
Paid subscriptions are processed by Lemon Squeezy, which serves as the Merchant of Record. By subscribing, you agree to Lemon Squeezy's Terms of Service. All fees are in USD. Monthly and annual subscriptions auto-renew unless cancelled before the next billing date via your Lemon Squeezy account. Lifetime licenses are one-time purchases with no recurring fees and entitle the holder to the feature set available at the time of purchase; material new features added after your purchase date may require a separate purchase.
You may not use the Service to:
AbaPeak and its underlying technology, including the note generation system, prompt architecture, and interface, are proprietary to IT Integrated Solutions LLC. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for your own clinical documentation purposes. You retain ownership of the notes you generate using the Service, provided your use complies with these Terms.
AbaPeak generates first-draft documentation based on the information you enter. You are responsible for reviewing, editing, and finalizing all notes before clinical use, submission to a payer, or inclusion in a client record. AbaPeak does not guarantee that generated notes will be accepted by any payer, satisfy any regulatory requirement, or meet the standards of any credentialing body. The Service is a drafting aid, not a clinical authority.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that generated content will be accurate, complete, or appropriate for any clinical purpose.
To the maximum extent permitted by applicable law, AbaPeak and IT Integrated Solutions LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including any clinical, billing, regulatory, or professional consequences of using generated notes. Our total aggregate liability for any claim arising under these Terms shall not exceed the total amount you paid for the Service in the twelve (12) months preceding the claim.
You agree to indemnify and hold harmless AbaPeak and its operator from and against any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Service in violation of these Terms or any applicable law.
We may suspend or terminate your access to the Service for violation of these Terms, non-payment, or other reasonable cause, with notice where practicable. You may cancel your subscription at any time through your Lemon Squeezy account. Termination does not entitle you to a refund except as required by law or Lemon Squeezy's refund policy.
We may update these Terms from time to time. We will notify users who have provided their email address of material changes. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. The "Last updated" date at the top of this page reflects the most recent revision.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and IT Integrated Solutions LLC regarding the Service and supersede all prior or contemporaneous understandings, representations, or agreements — written or oral — relating to the Service. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts of Broward County, Florida, and you consent to personal jurisdiction in those courts.
